Phat Ass Production Studios Inc., (“We” or the "Company") pledges to be responsible to the public in providing our Website service and merchandise and in the course of serving customers, gathering their Personal Information. The privacy and the integrity of people’s Personal Information are very important to us. Children’s privacy is also very important to us, and we do not knowingly collect any personal or financial information from minors.

This Privacy Policy is intended to provide you with specifics of the information we may collect from you, how we use it, disclose it and retain it, and the guidelines that we adhere to in order to protect that information. Any Personal Information you provide to us is managed according to Canadian privacy legislation (federal and provincial), the Safe Harbor provisions in the United States, the European Union Privacy Directive, and the Data Protection Act in the United Kingdom. Additionally, we aim to adhere to a coherent privacy policy for those regions of the world which may not have privacy legislation at this time. This means that prior to or at the time of collection you will be informed that your Personal Information is being collected, the purpose(s) of collection, use and disclosure, and the name and contact information of our Privacy Officer so that you can ask any questions that you may have in regard to the collection, use and disclosure of your Personal Information.

We will from time to time review and revise our Privacy Policy, and any amendments will be implemented as soon as reasonably possible on our Website. Policy amendments apply to Personal Information collected from the date of the posting of the amendments and to existing information held by the Company. As such, this Privacy Policy applies to existing information we have collected from you to date.

Contact information: Personal information is any information that can be used to identify, contact or distinguish a specific individual. Business contact information, often referred to as 'business card' information, and publicly available information such as that in telephone directories are not considered to be “Personal Information”.

Your legal name, address and e-mail address are "Personal Information" and shall be maintained as confidential information with respect to other users or Members of our Website in our secure database. We may use Personal Information to facilitate your user experience with our Website, as well as, when necessary, to contact you. We will not sell or provide your contact information to any other organization which may be interested in making unsolicited contacts.

Your e-mail address will also be stored in our secure database, and only we may use this address to contact you with e-bulletins, announcements and information regarding notifications of news and customer service issues. We may send e-mail newsletters to members and may periodically send e-mails about new services, improvements, and scheduled service interruptions.

Information we collect and how we use it:

Minors: Our Website is intended for users age sixteen (16) and older. We do not knowingly collect or use any Personal Information from children under the age of sixteen (16)) and shall delete any information in our database that we know originates from a child under the age of sixteen (16).

Web Privacy: In order to operate this Website, we automatically collect website reporting activity information, including tracking information such as browser type, type of operating system you are using, name of your Internet service provider, and the pages you visit to allow us to assess how to improve our customers’ and the public’s experience on our Website, how long individuals spend on our Website, and which pages or features receive attention. This allows us to further manage and develop our business and operations by assessing the public’s usage of our Website and services. It may also be used for internal purposes such as marketing and industry reporting. None of this website reporting activity information is personally identifiable to you.

Cookies: We may use 'cookies' to simplify the user's experience. If you set your browser to reject cookies, the Website may not function properly. Our database resides behind a firewall in order to protect against the loss, misuse and alteration of the information under our control. We have taken industry standard preventive measures to restrict access to sensitive data, as well as to detect and prohibit certain connections and operations by unauthorized users. No claim is made as to the impenetrability as no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security or resiliency to future attacks.

Basic Membership Registration Data: When you register with us as a Member, we create a User Account for you and you will receive a user login and password. We ask for your full legal name, your Website user name, your address, your e-mail address and your birth date ("Personal Information"), and we respond to your e-mail address with your registration information. This allows us to create a profile for you as a Member to facilitate your use of our Website.

You provide us with this Personal Information on a voluntary basis, and you do not have to become a Member, You can still access some of our Website as a non-Member.

All other personal and private information submitted by you is confidential and will not be disclosed except as required by law or to protect members of our Website. All personal and private information can be updated or deleted (resulting in termination of the right to use or of your Membership) by you at any time.

Payment Information: We endeavour that every transaction made with us is as secure and safe as possible. We utilize the on-line payment services of PayPal to provide you with a secure shopping experience. For more information on PayPal, please refer to www.PayPal.com.

We do not store any of your PayPal account information online, which makes it virtually impossible for your PayPal account information to be stolen over the Internet. We consistently ensure that your contact information and PayPal transactions are secure and safe through the most convenient and efficient methods available.

Use of your Personal Information--Order and Payment Processing, Customer Service, and Quality Assurance: We use Personal Information to help us efficiently perform transactions with you, to provide you with access to our Website, to perform quality assurance, sales analyses and other business analyses. In some cases we may use service providers to help us perform some of these tasks, including, but not limited to, processing or fulfilling your merchandise orders or performing customer service, business analyses or quality control (e.g. postal or delivery services to deliver your merchandise to you), and we may share your Personal Information with these service providers for the limited purpose of delivering that service to you. In order to ensure the integrity of your Personal Information we require these third-party service providers to enter into confidentiality agreements in regard to handling your Personal Information.

Applying to the Company for an Employment or Contractor position: By applying to the Company for any position, including posted opportunities and unsolicited applications, you consent to the collection, use and necessary disclosure of the personal information provided during the application and selection processes.

We collect your personal information in this process in order to assess your qualifications and suitability as a potential employee or contractor of the Company. This information will be reviewed by the Company's employees with hiring-related duties. In addition, it will become part of our database of candidates, which we may search to locate qualified candidates for specific positions as they arise.

Should you accept employment with us, your personal information will be disclosed to third party insurers and providers of employee benefits; to Canadian and/or United States governmental authorities including the Customs and Revenue Agency and to the Internal Revenue Service; to consultants advising us on employment, benefits and pension issues; to our other employees in human resources, payroll, or in management positions, and to our legal counsel if relevant in legal matters.

If you do not accept a position with us, we may retain your personal information in our database for up to one (1) year. You have the right to correct, update or delete your personal information in and from our database at any time before accepting employment with us. To delete your personal information from our database, please send a request to the e-mail address below.

If you do accept a position with us, we will ask you for and retain personal information throughout your employment and for at least ten (10) years following the termination of your employment for any reason. Throughout that period, you have the right to request correction of any errors in the personal information in our possession.

We do not sell, rent, or provide your personal information collected through the application, recruitment and employment processes to any third party, although it may be passed on to a third party in the event of a transfer of ownership or assets, or a bankruptcy, of our Company.

Disclosure to Third Parties: We do not sell, license, rent, lease or otherwise make available any of your Personal Information with/to third parties, unless required by law, of which disclosure you will be informed prior to or contemporaneously with such disclosure, citing the appropriate statute under which the disclosure is required.

Security and Confidentiality of Your Personal Information: The security of your Personal Information is important to us. We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

Maintaining the integrity, security and confidentiality of your Personal Information is one of our highest priorities. Our employees are trained in our privacy practices and the proper handling of Personal Information. We limit our employee's access to your Personal Information by authorizing only certain employees at any given time to those who need to know the Personal Information for us to provide the products and services that you request from us. We are committed to maintaining strict physical, electronic and procedural safeguards which comply with provincial and federal legislation and commercially reasonable industry standards to protect your Personal Information. We consistently review and improve our security standards, practices and procedures as needed to protect against unauthorized access and use of the Personal Information.

We assume no liability for any disclosure of data due to errors in transmission, unauthorized third party access or other acts of third parties, or acts or omissions beyond our reasonable control. The content that you store, post, or transmit on or through the Website, such as message board postings and images may be accessed by other users, including people that you do not know. We are not responsible for the actions of others. Therefore, you should use care in communicating with other users and only disclose your Personal Information to other users that you know to be trustworthy.

Length of time of retention of your Personal Information: We only retain your Personal Information for as long as necessary for the purposes for which we have collected the information, and/or as required by statutes. The maximum length of time we retain your Personal Information for is seven (7) years, or until such time as you request that we not collect and retain your Personal Information by emailing us at PhatAss@PhatAssProduction.ca, after which we destroy any electronically held information and shred any paper files of information and dispose of them legally.

Disclosure of Personal Information for Legal Reasons: We may be required to disclose specific personal information when such disclosure is necessary to comply with law, to cooperate with law enforcement or to protect the interests or safety of our employees and agents. Whenever possible, you will be advised prior to such disclosure. Your personal information may be passed on to a third party in the event of a transfer of ownership or assets, or a bankruptcy, of the Company.

Limits to our Privacy Policy: Our Privacy Policy only applies to our Website and employees, and DOES NOT apply to any links to other resources provided on our Website or recommendations made by our employees or other Website users and/or members for products and services not directly offered by us. These other resources may operate under different privacy practices for which you have the sole responsibility of reviewing as we have no control over the information submitted to or collected by these other entities.

If you send us e-mail or use our feedback form to contact us, you will be providing us with some Personal Information including your name, e-mail and perhaps information about your personal circumstances. This information is only used to process and respond to your question or comment, and is collected in compliance with privacy legislation. This information is not disclosed except to authorized employees who need it to answer your question and for no other purpose.
